Sunshine Coast childcare worker Arvind Ajay Singh guilty of indecent treatment of child

A former childcare worker has been found not guilty of raping a child but guilty of indecent treatment of a child in his care on the Sunshine Coast.

Arvind Ajay Singh, 43, was accused of digitally raping the child and pleaded not guilty to the charge.

Across the three-day trial, the 12 jurors heard from 10 witnesses — including the victim.

Late on Thursday afternoon, after hours of deliberation and requesting to watch the child's video evidence a second time, the jury found Singh not guilty of rape.

He was instead found guilty of a lesser charge of indecent treatment of a child under 16 years, under 12 years of age, in his care.

Crown prosecutor Alex Stark told the jury in his closing statement that the victim was a child who was completely innocent of the sexual nature of what they were showing and telling police and their parents.

"[They have] no awareness of the significance or nature of what happened except that it tickled and [they] don't like it."

Defence barrister Lachlan Ygoa-McKeown told the jury that Singh was not guilty of either charge and had never touched the child's underwear or genitals.

Mr Ygoa-McKeown called the child's evidence "vague" and "weak".

The court heard DNA testing came back neutral and did not support either case.

Singh has been remanded in custody and will be sentenced at Maroochydore District Court on Friday.
